Former Fulton County Assistant D.A.: "I suspect there will be an indictment this week"

Fulton County District Attorney Fani Willis is expected to begin presenting her case about the 2020 elections interference against former President Donald Trump and his allies to a grand jury beginning Monday.

Speculation began Saturday when former Georgia Lt. Governor Geoff Duncan and journalist George Chidi both confirmed that they received notifications they will testify on Tuesday. A Willis spokesman had no comment but the timeline tracks with past racketeering cases. Willis has taken about 2 days to present them. That would be why Duncan and Chidi are scheduled for Tuesday. It is thought that Willis is making a RICO case against Trump and his allies.

Former Fulton County Assistant District Attorney Darryl Cohen said Sunday that the indictment anticipated this week will likely be a lengthy one.

It is possible that the public will know whether jurors hand up indictments against Trump and maybe others by Tuesday evening.

Chidi tweeted confirmation that he was called by the DA’s office and “asked to come to court Tuesday for testimony before the grand jury.” The Atlanta Journal-Constitution confirmed Duncan’s appearance date. In other words, this case in Georgia that has been talked about for two years looks to be coming to a conclusion this week about whether or not Trump will be indicted. All signs point to yes, he will be indicted. And, his allies may be indicted, too.

Two state legislators have been subpoenaed.

Former Democratic state Sen. Jen Jordan, who was also subpoenaed, did not immediately respond to a request for comment. Former state Rep. Bee Nguyen, who was similarly put on notice that she could be called, declined to comment.

Jordan and Nguyen, who both ran for statewide office last year, heard falsehood-filled testimony from Trump attorney Rudy Giuliani during state legislative hearings in late 2020 — and forcefully pushed back on conspiracy theories that Trump’s allies were promoting.

Chidi is an independent journalist who met with fake Republican electors at the state Capitol. They were there as allies of Trump to undermine Biden’s narrow victory in 2020.

Duncan was once an ally of Trump but broke from him during the “stop the steal” movement that spread after the 2020 election. He’s ready to answer the questions from the grand jury.

As president of the state Senate, Duncan stripped titles from a trio of lawmakers who backed Trump’s push to overturn the election of leadership posts. He then refused to endorse one of them, then-state Sen. Burt Jones, after he won the GOP nomination to succeed him as Georgia’s No. 2 politician.

“I look forward to answering their questions around the 2020 election,” Duncan said about the grand jury. “Republicans should never let honesty be mistaken for weakness.”

Georgia Secretary of State Brad Raffensperger – the person on the phone call from Trump asking that his office “find” 11,000 more votes so he could win the state – has not heard from the D.A.’s office recently, he said. “They’re doing what they’re doing, whatever that is.”

Trump has been busy attacking Willis and her office on Truth Social over the investigation. He called her racist and said the grand jury investigation is a waste of taxpayer money. That doesn’t seem like a smart strategy to me, but I’m not Trump. Trump is being Trump.

I’ve often said that Trump should probably be most concerned about the Georgia investigation as far as criminal charges against him go. RICO charges are the kind that will get him sent to prison and Willis has appeared determined from the beginning to put him away. Plus, she is up for re-election and that puts another dimension on the case. She has a reputation for being focused and tough.
