DA George Gascon continues to bring his special brand of justice to Los Angeles

How has DA George Gascon failed the city of Los Angeles lately? Let me count the ways. Just last week Allahpundit wrote about the ongoing train robberies that have turned a portion of the tracks in Lincoln Heights into a lawless zone where thieves steal an average of 90 packages per day.

Union Pacific has its own police force to deal with crimes that happen along the rail system. What it does not have is its own District Attorney. Last Friday Union Pacific asked Gascon to reconsider his own special directive that calls for the pre-trial dismissal of 13 misdemeanors. The statement Friday echoed a letter UP sent to Gascon last December asking for help to deal with the rising theft.

UP’s state director of public affairs, Adrian Guerrero, called the issue “incredibly disappointing and frustrating.”

“But that’s the reality of what Union Pacific has been facing over the past year, and it’s helping us shine a light on this issue. I think it’s a call to action for a number of stakeholders involved in this issue because…there are a number of folks being impacted by this,” Guerrero told Fox News Digital, adding that UP has engaged with the Los Angeles Police Department, Sheriff’s Office and California Highway Patrol to target the thefts…

Guerrero’s letter to Gascon continued: “UP and our goods movement partners strongly urge you to reconsider the policies detailed in Special Directive 20-07. While we understand the well-intended social justice goals of the policy, we need our justice system to support our partnership efforts with local law enforcement, hold these criminals accountable, and most important, help protect our employees and the critical local and national rail network.”

Organized criminal syndicates that plan thefts along the railroad system recruit minors and homeless individuals “by force” and have them break into trains and pull boxes and put them “into vehicles,” he explained.

So if you’re wondering why it’s open season for package thieves in LA, Union Pacific says it’s the social-justice minded policies of George Gascon.

Also last week I wrote about the murder of a 27-year-old off-duty police officer named Fernando Arroyos who was shot and killed by a group of men while he was out house hunting with his girlfriend. Four people (three men and one woman) have been arrested in connection with his death. They are all gang members but rather than risk letting Gascon’s office handle the case, the local Sheriff instead asked the feds to take over.

Los Angeles County Sheriff Alex Villanueva handed the case to federal authorities, bypassing L.A. County District Attorney George Gascón.

Is this a show of no confidence in the district attorney? LAPD Chief Michel Moore skirted that issue at a Thursday night press conference announcing criminal charges filed against the four individuals in Arroyos’ murder, but the sheriff did not. Villanueva said that Gascón’s office would not charge the suspects appropriately…

“We definitely had a conversation with the local DAs and their response was not satisfactory to the gravity of this situation. They were consistent with the special orders from the District Attorney…and I believe their plan was just prosecute a simple murder with no gun enhancements, no gang enhancements, nothing. And that did not really cover the depravity of this crime,” said Villanueva.

Gascon announced when he took office that he would not be adding sentencing enhancements (such as gang affiliation) to charges. In this case, a spokesman for his office claimed they were “never consulted” before the case was handed off to the feds. But according to “multiple” law enforcement sources, Gascon’s office is lying:

Multiple law enforcement sources disputed the DA’s account, telling the NBC4 ITeam that while there may not have been a formal presentation of evidence, there were numerous discussions earlier this week between investigators and DA’s office personnel about the facts of the case and the potential charges involved.

There’s really no reason to think Gascon was going to violate his own rules about sentencing enhancements in this case. His office can claim they weren’t asked but if they had been this would have turned out exactly as the Sheriff suggests it would have.

Finally, for anyone who has any doubt that Gascon is always looking to go easy on criminals there’s a new story out today which might change your mind. The case involves a trans woman who sexually assaulted a 10-year-old girl in a bathroom. However, because the assault happened weeks before the assailant’s 18th-birthday, Gascon is treating her as a juvenile, despite a record of continued crimes since then.

A 26-year-old woman who pleaded guilty to sexually assaulting a 10-year-old girl in Palmdale might be sentenced to a short stay in juvenile hall or granted probation at a court hearing this month, sparking another round of outrage over Los Angeles County Dist. Atty. George Gascón’s all-or-nothing criminal justice reform platform…

[Hannah] Tubbs, who identifies as female, was two weeks shy of her 18th birthday when prosecutors say she walked into the women’s restroom of a Denny’s restaurant in 2014, grabbed a 10-year-old girl by the throat and locked her in a stall, court records show. Tubbs then shoved her hand down the girl’s pants and sexually assaulted her, prosecutors say, stopping only after someone else entered the restroom…

Jon Hatami, a longtime prosecutor of crimes against children who has emerged as a leading voice of the recall movement, said charges clearly should have been brought in adult court.

“This clearly shows you the dangerous aspect of the blanket policies of George Gascón,” he said. “Here you have a person who has committed at least two separate sexual assaults of young girls who is now 26 years old and has a history of violent conduct in the past. This is not somebody who should appear in the juvenile system.”

Under pressure to defend his handling of the case, Gascon has argued that Tubbs might be placed in danger if convicted and sentenced as an adult. So, as always, his concern is with the criminal’s safety, not with the safety of the community from the criminal.

Anyway, this is just a brief window into how things are going in Los Angeles under the watchful eye of DA Gascon. If you like rampant lawlessness and criminals who receive either minimum punishment or no punishment at all for their crimes, then you Gascon is the perfect DA.
